These Terms of Service (“Terms”) govern your access to and use of the hosting, virtual private server (VPS), cloud infrastructure, and related services (“Services”) provided by Eagle Servers LLC, a Wyoming limited liability company (“Company”, “we”, “us”, “our”).
By accessing or using our Services, you agree to be legally bound by these Terms.
You agree not to use the Services for any unlawful, harmful, or abusive activity, including but not limited to:
Distribution of malware, ransomware, viruses, or malicious software
Phishing, identity theft, or fraudulent activity
Launching or participating in DDoS attacks
Unauthorized penetration testing or vulnerability scanning
Hosting illegal, copyrighted, or prohibited content
Spam, bulk email abuse, or network misuse
Child exploitation content, violence, terrorism, or hate material
Any activity prohibited under U.S. federal law or Wyoming state law
Violations may result in immediate suspension or termination without refund, and may be reported to law enforcement.
While we strive for stable and reliable operations, we make no guarantees regarding:
Uninterrupted uptime
Zero downtime
Zero data loss
Continuous accessibility
Latency, performance, or network throughput
All Services are provided “as-is” and “as available”, without warranties of any kind.
You are responsible for:
Maintaining the confidentiality of your account credentials
Securing your devices and access points
Monitoring all activity conducted under your account
Ensuring compliance with all policies, including AUP (Acceptable Use Policy)
Preventing unauthorized access to your systems
Any action performed under your account is deemed to have been performed by you.
Services are billed in advance, unless stated otherwise.
Failure to pay may result in service suspension or termination.
Chargebacks or payment disputes will result in immediate account termination.
Fees for Services are non-refundable, unless required by applicable law.
Voluntary contributions or donations are not considered service payments and do not entitle you to service credits.
We are not responsible for:
Customer data loss or corruption
Service interruptions or outages
System failures
Unauthorized access due to your actions or negligence
Third-party outages or upstream provider failures
Any indirect, incidental, or consequential damages
Your sole and exclusive remedy for dissatisfaction with the Services is to stop using them.
To protect your data, you are solely responsible for maintaining backups.
We may suspend or terminate your account at any time, with or without prior notice, for:
Violations of these Terms or our Acceptable Use Policy
Non-payment or payment disputes
Security risks or threats to our infrastructure
Network abuse, resource abuse, or excessive load
Fraud or suspected fraudulent activity
No refunds are issued for accounts suspended or terminated due to violations or misuse.
We reserve the right to:
Modify or discontinue any Service
Change resource allocations
Adjust pricing or billing structures
Update policies, Terms, or technical requirements
Continued use of the Services constitutes acceptance of any changes.
These Terms shall be governed by and construed in accordance with the laws of:
The State of Wyoming, USA,
without regard to conflict-of-law principles.
Any legal action shall be brought exclusively in courts located in Wyoming.
